These Terms and Conditions (“Terms”) are an agreement between Villa La Kookaburra (“La Kookaburra”) and you or the entity you represent (“you“). By registering for or participating in a Kookaburra (“retreat”), you confirm that you have read, understand and agree to these Terms and Privacy Policy (“Privacy Policy”).

1. Information on this website

The information on this website has been prepared solely for the purpose of providing information about Villa La Kookaburra its services, subsidiaries and products. Villa La Kookaburra will use reasonable care to ensure that the information is accurate at the time it is added to the website. However Villa La Kookaburra cannot guarantee that the information is accurate and it shall not be liable for any loss or damage that anyone may suffer in reliance on the information on this website.

Any and all information is subject to change without notice. Publications are subject to availability and their provision is at the discretion of Villa La Kookaburra. You agree that Villa La Kookaburra will not be liable for any direct, indirect or consequential loss arising from the use of the information and material contained in this website or from access to other material on the Internet via web links from this site.

Links within this website may lead to other websites however Villa La Kookaburra assumes no responsibility for the contents of any other websites to which this website has links, as we may not have control over such websites. The inclusion of any links to such other websites does not mean that Villa La Kookaburra sponsors, endorses or otherwise approves any information or material contained in those sites, or in sites linked to those sites, or has any association with the owner thereof. Any contract for goods or services entered into through such websites will be made with the owners or controllers of those websites and not with Villa La Kookaburra.

2. Registration

To register for the Event, you must complete the Retreat registration process and pay all required registration fees (if any) prior to any deadlines described on the registration page for the Retreat. Retreat registrations are subject to availability and may close earlier than posted deadlines.

3. Payment

If the registration page for the Retreat states that registration fees or other fees are required for the Retreat, payment must be made at the time you register for the Retreat. Kookaburra reserves the right to cancel your registration without notice for failure to pay in accordance with these Terms. Kookaburra is not responsible for any damages, direct or indirect, resulting from such cancellation.

4. Cancelation by You

In case of cancelation by you the following policy applies;

More than 42 days before the planned day of arrival: owed 30% of the total payment sum.
Between 43 and 29 days before the planned day of arrival: owed 35% of the total rental sum.
Between 30 and 22 days before the planned day of arrival: owed 40% of the total rental sum.
Between 23 and 15 days before the planned day of arrival: owed 60% of the total rental sum.
Between 16 and 5 days before the planned day of arrival: owed 80% of the total rental sum.
Less than 5 days before the planned day of arrival: owed 100% of the total rental sum.

It is not possible to reclaim down payments. This risk can be covered by taking up cancellation insurance.

5. Event Program and Cancellation by Us

The Retreat program is subject to change. Kookaburra may cancel the Retreat at any time and may deny, limit or cancel a registration for the Retreat (including a confirmed registration) at any time. Kookaburra is not responsible for any damages, direct or indirect, resulting from such cancellation. If Kookaburra cancels the Retreat or your registration, so long as you are in compliance with these Terms and any refund policy listed on the registration page for the Retreat, Kookaburra will issue you a full refund of any Retreat registration fee that you have paid in accordance with these Terms.

6. COVID 19

As long as there is no lockdown, retreats won’t get canceled. So even if your government gives negative travel advice for Spain, the Retreat will not be canceled. It’s an advice not a prohibition, and Kookaburra is confident to offer a safe, relaxing retreat. If you do decide to cancel your reservation, we appeal to our cancelation policy. (4).

In case of a lockdown or an entry ban we understand that you cannot come to the retreat. In this case we offer two options:

You cancel your reservation according to our cancelation policy
You move your reservation without cost to a retreat in the near future

7. Code of Conduct

You agree to behave in such a way as to create a safe, supportive environment while participating in the Retreat. You agree not to engage in disruptive speech or behavior or otherwise interfere with the Retreat or other individuals’ participation in the Retreat. You will comply with all applicable laws and agree not to engage in any form of harassing, offensive, discriminatory or threatening speech or behavior, including relating to race, gender, sexual orientation, religion or disability. Kookaburra may require participants engaging or threatening to engage in such behavior to leave the Retreat immediately and such participants will not be eligible to receive a refund of any fees paid to Kookaburra related to the Retreat.

8. Assumption of Risk

You acknowledge and agree that your attendance and participation in the Event is voluntary. You agree to assume the risks associated with attending and participating in the Event to the fullest extent permitted under applicable law.

9. Complaints

Despite all our efforts, it is possible that you believe you have a justified complaint. This complaint must, as far as possible, be submitted on site. If direct submission is not possible or if the complaint can not be resolved satisfactorily, it must be submitted in writing within two weeks after termination of the retreat, motivated and submitted to us. Complaints submitted later will not be accepted and an alleged right of action will lapse.

10. Information About You

Your contact details and other information will be handled in accordance with the information handling practices described in the Privacy Policy. You consent to the collection, use and disclosure of the information you provide in connection with the Retreat by Kookaburra and its affiliates in accordance with that Privacy Policy. Those entities will use your contact information to send details and announcements to you related to the Retreat, and communicate with you about other Kookaburra offers, events or services. You can unsubscribe from promotional emails at any time by clicking the unsubscribe link in those emails.

11. License to Use Items

In consideration of the opportunity to participate in the Retreat, you grant to La Kookaburra. and its affiliates, successors and assigns, and their respective licensees, advertising agencies, promotion agencies and fulfillment agencies, and the contractors, officers, directors and agents of each and all of them (“Authorized Persons”) an irrevocable, nonexclusive, royalty-free right and license throughout the world and in perpetuity to reproduce, edit, publish, distribute or translate, for advertising, publicity and promotional purposes or for any other purpose relating to their business, all or any part of the following items (“Items”): (a) all still photographs and all audio and video recordings that any Authorized Person makes of you or your voice or likeness in connection with the Retreat, including the right to use your name, likeness and biographical information, and (b) all materials (electronic or hard copy) submitted or presented by you in connection with the Retreat, including any materials submitted via social media handles associated with the Retreat.

12. Release of Claims

To the extent permissible by applicable law, you (for yourself, your heirs, personal representatives, assigns, and anyone else who might make a claim on your behalf) hereby release La Kookaburra and its affiliates, and their respective directors, officers, contractors, representatives, agents, successors and assigns, from any and all claims, demands, causes of action, suits, damages, losses, debts, liabilities, costs and expenses (including without limitation reasonable attorneys’ fees and costs) that you may have now or in the future associated in any way with the Retreat or the Items.
